Terms of service
Who these terms are for
- Houses and their team members who sign in to run bookings. Whoever accepts these terms for a House confirms they may do so on its behalf.
- Clients of a House — schools, teachers, tour operators and groups — who book through a House's booking form, client portal or Visit Pass. Your booking, its prices and its policies are with the House, not with ARCA.
The service
ARCA lets a House take booking requests, schedule visits, send quotations and invoices, record payments, run a client portal, check groups in on the day and report on it all. We may improve and change features over time; we will not remove something a House relies on without reasonable notice.
ARCA does not hold, collect or move money. Payments are made directly between a client and the House (for example by EFT, card machine or purchase order); ARCA records them.
Accounts and access
Keep your sign-in details to yourself and tell us straight away if you think someone else has used your account. A House decides who joins its team and what each person may do (roles and permissions), and is responsible for what its team does in ARCA. Our support staff only enter a House's workspace when the House allows it.
What a House is responsible for
- Its clients' information: the House is the responsible party under POPIA for the personal information it collects through ARCA, and must have a lawful reason to collect it. ARCA processes it as the House's operator — see our privacy policy.
- Its prices, policies and documents: rates, deposits, cancellation fees, VAT registration and the content of its quotations and invoices. ARCA provides the tools; the House is responsible for its own tax and consumer-law obligations.
- Its email: emails are sent from the mailbox the House connects, in the House's name. The House is responsible for what it sends and for having the right to use that mailbox.
- Its bank details and the accuracy of what it records.
Acceptable use
Don't use ARCA to break the law, send spam, upload harmful files, try to reach another House's information, overload or probe the service, or copy or resell it. We may suspend access that puts the service or other users at risk.
Fees
A House pays the subscription set out in its House Service Agreement and subscription schedule. Using a client portal or booking form is free for a House's clients.
Your data
A House owns its information: its bookings, clients, programmes, documents and records. We use it only to provide the service, as our privacy policy explains. A House can export its records, and when it leaves ARCA its account stays available read-only for 60 days so it can export everything; after that it is deleted, except records we must keep by law.
ARCA owns the software, its design and its brand. Nothing in these terms transfers that ownership.
Availability and support
We work to keep ARCA available and secure and to fix problems promptly, but we cannot promise it will never be interrupted — for example during maintenance or because of a provider outage. Support is available from support@arca.africa and within ARCA.
Ending the service
A House may cancel on 30 days' written notice, effective at the end of its paid billing period. We may suspend access for non-payment after 14 days' notice, or straight away if there is a security risk or a serious breach of these terms.
Liability
To the extent the law allows, ARCA is not liable for indirect or consequential loss, and our total liability to a House is limited to the subscription fees it paid in the 12 months before the claim. Nothing in these terms limits rights that the Consumer Protection Act or other law gives you and that cannot be excluded.
Changes, law and contact
We may update these terms and will tell Houses about significant changes before they take effect. These terms are governed by the laws of the Republic of South Africa. Questions: support@arca.africa.
